This policy represents your web design agreement with E2Soft Solution, in addition to all emails exchanged between us and you. The following terms and conditions apply to all website development / design services provided by E2Soft Solution to the Client. These Terms and Conditions set forth the provisions under which the Client may use the services supplied.
A down payment is required in order to begin development of your website. This is usually 50% of the upfront design fee, unless an alternative contract or proposal specifies a different amount. The outstanding balance on your website is due after the design, navigation and pages have been approved and built. Final payment is due regardless of whether all content for the pages has been sent by the client. This provision is in place to encourage the client to get content submitted promptly so that their site can go live. It also ensures that E2soft Solution gets paid for performing their duty under the proposal, despite tardy content from the client. After payment, E2soft Solution will still post outstanding content AT NO CHARGE for 3 months. In the event an “under construction” page is posted due to missing content, E2soft Solution will post ONE copy of any text/pictures on existing pages only, for up to 3 months after publish date. After the three months have expired, content posted to site will be billable at our current regular hourly rate. In the event that design and navigation changes are requested after they have been specifically approved by the client, these changes will be billable at our current regular hourly rate.
We offer limited hosting services by buying server space from E2Soft Solution. They have great customer and technical support and service guarantee for an annual average of 99% network availability for their infrastructure. Should you require any additional information, please refer to the E2Soft Solution’s own websites for their terms and conditions.
If the Client’s website is to be installed on a third-party server, E2Soft Solution must be granted temporary read/write access to the Client’s storage directories which must be accessible via FTP. Depending on the specific nature of the project, other resources might also need to be configured on the server.
Payment is due when Designer completes each milestone as listed in the Work Plan and Milestones schedule, and Client accepts the Deliverables for that milestone.
E2Soft Solution will provide the Client with an opportunity to review the appearance and content of the website during the design phase and once the overall website development is completed. At the completion of the project, such materials will be deemed to be accepted and approved unless the Client notifies E2Soft Solution otherwise within ten (10) days of the date the materials are made available to the Client.
The Developer and any third party associates shall use information provided by the Client in relation to this agreement in accordance with the Data Protection Act 1998. This information will also be used to identify the Client in communications with them and to contact the Client from time to time to offer those services or products that may be of interest to or benefit the Client.
